Hottest Topics in Fairlawn-Bath for 2012: Rothrock Road

In the next few days we'll look at three important news topics for Fairlawn and Bath Township in 2012. Here's the second installment.

There's a lot happening in Fairlawn and Bath at any one time, but there are three topics that people buzzed about most this year: panhandling, Rothrock Road and crime. In this three-part series, we'll break down these three topics. Next up is the infamous Rothrock Road trial that took place this summer. Check back for the third part of our series on Tuesday. Rothrock Road Before we dive into this recap, let me start by saying that Summit County Common Pleas Judge Allison McCarty still has not made a decision in this trial. On June 1, Copley Township and Fairlawn went to court in the battle over the closure of Rothrock Road. The conflict began in 2011 when Walmart announced it wanted to move into Copley Township. Mayor William Roth made the…

I don't know what the judge thinks she's going to hatch by sitting on this! But it is all to simple for me! I was thinking not long ago (unusual for me) but I realized that when the state built the 21 to 77 ramp that took out a section of "original" Rothrock Road, a study was done at that time, which determined its IMPORTANCE of this road as a "conector road" and rearranged it in its new location…   more ›

Land at Future Rothrock Road Walmart Site Officially Belongs to Walmart

The Akron Beacon Journal reports the land was sold to Walmart in September and now someone is suing Copley over it.

It looks like plans to build a proposed Walmart and Sam's Club on Rothrock Road in Copley Township are moving forward. The Akron Beacon Journal reports  that on Sept. 20, Larry Levey, of LRC Development Co., sold the property to Walmart for $480,000. As a result of the sale, the owner of Fairway Park Apartments is suing Copley Township. Read more from the Beacon here.

No Decision in Copley Vs. Fairlawn Rothrock Road Trial

Decision not likely this week, lawyer says.

When it comes to the Copley vs. Fairlawn suit over the closing of Rothrock Road, no news is news: No decision has come yet regarding the suit closing Rothrock to public traffic in response to Walmart's plans to move about a mile down the road into Copley Township.  Copley Township attorney Irv Sugerman said he doesn't expect a decision to be made this week.  We'll keep you posted.

Roth: Lost Walmart Revenue Not an Issue, I'm Concerned About Runoff'

Fairlawn's Mayor William Roth was the final witness in the Copley v. Fairlawn Rothrock Road trial Wednesday.

It was more of the same in the final day of the Rothrock Road closure trial, as Fairlawn's Mayor William Roth took the stand as the city's last witness. Roth was on the stand for six hours, which is a half hour longer than the previous testimony record set by Jason Segedy, director of the Akron Metropolitan Area Transportation Study. Roth had previously testified as if on cross examination for Copley Township attorney Irv Sugerman and Jacob Pollock attorney Jordan Berns. He stated many of the same things in Fairlawn's direct examination Wednesday. Take our poll: Who should win the Copley v. Fairlawn Rothrock Road closure trial? "I'm concerned about the environmental effect on the area if big-box retail goes in there," Roth said. "Our goal …

Catch Up: Last Witness in Rothrock Road Trial Takes Stand Wednesday

Have you missed any part of the Rothrock Road trial so far? Catch up here.

We're down to the last witness in the Copley v. Fairlawn Rothrock Road closure trial. Court has been in session for almost two months, and Fairlawn will call Mayor William Roth to the stand Wednesday morning. The trial started June 1 in Summit County Common Pleas Judge Alison McCarty's courtroom. Fairlawn attorneys Stephen Funk and Marshal Pitchford argue that closing Rothrock Road at Sawgrass Drive and installing a gate at Rosemont Boulevard will not slow response times for emergency vehicles to get to and from Copley Place or anywhere else in that area. Copley Township attorney Irv Sugerman and attorneys Jordan Berns and Tim Duff, who represent Fairlawn resident Jacob Pollock, say closing Rothrock will slow response times and that it's …

Copley Township, Jacob Pollock Attorneys Rest in Rothrock Road Trial

Tuesday was the ninth day of trial in the Copley v. Fairlawn Rothrock Road closure trial.

Plaintiff attorneys for Copley Township and Jacob Pollock officially rested their case Tuesday after hearing testimony from Dan Zarkovacki, part owner of the Fairway Park Apartments.  Summit County Common Pleas Judge Alison McCarty allowed Fairlawn to call witnesses before the plaintiffs rested because Pollock's attorney Jordan Berns couldn't schedule Zarkovacki to be in the courtroom any earlier.  Check out a play-by-play feed from Tuesday's court session here. Berns asked Zarkovacki several questions about the building of a proposed Walmart and Sam's Club complex on Rothrock Road and the filing of litigation challenging the zoning of the area.  Zarkovacki said the litigation was filed by Fairway Park Apartments against Copley Township. …
