Rothrock Road Trial Wraps Up, Judge Commends Lawyers for Passion

Summit County Common Please Judge Alison McCarty heard closing arguments Friday.

After a month and a half of trial, the Copley v. Fairlawn Rothrock Road closure trial has come to a close. Attorneys for Copley, Fairlawn and Jacob Pollock gave their closing arguments Friday afternoon in Judge Alison McCarty's courtroom. To make it easy, we'll break apart the closing arguments by attorney. Here's what each one had to say: Jordan Berns, representing Jacob Pollock • "Closing Rothrock Road is illegal for two separate reasons: it's being conducted in bad faith and it is per say unreasonable because it's a principal highway and it connects two communties." • "The first reason Fairlawn's plan is illegal is because it's being carried out in bad faith. Roth: Lost Walmart Revenue Not an Issue, I'm Concerned About Runoff'

Fairlawn's Mayor William Roth was the final witness in the Copley v. Fairlawn Rothrock Road trial Wednesday.

It was more of the same in the final day of the Rothrock Road closure trial, as Fairlawn's Mayor William Roth took the stand as the city's last witness. Roth was on the stand for six hours, which is a half hour longer than the previous testimony record set by Jason Segedy, director of the Akron Metropolitan Area Transportation Study. Roth had previously testified as if on cross examination for Copley Township attorney Irv Sugerman and Jacob Pollock attorney Jordan Berns. Catch Up: Last Witness in Rothrock Road Trial Takes Stand Wednesday

We're down to the last witness in the Copley v. Fairlawn Rothrock Road closure trial. Court has been in session for almost two months, and Fairlawn will call Mayor William Roth to the stand Wednesday morning. The trial started June 1 in Summit County Common Pleas Judge Alison McCarty's courtroom. Fairlawn attorneys Stephen Funk and Marshal Pitchford argue that closing Rothrock Road at Sawgrass Drive and installing a gate at Rosemont Boulevard will not slow response times for emergency vehicles to get to and from Copley Place or anywhere else in that area. Chief Hose: Blocking Rothrock Would Not Hurt Copley Township

Fairlawn fire Chief Russ Hose testified on Day 10 of the Rothrock Road closure trial.

Fairlawn attorneys called their second to last witness to the stand in the Rothrock Road closure trial, and he said closing the road will not hurt Copley Township's ability to respond efficiently to Copley Place. Fairlawn fire Chief Russ Hose testified in Summit County Common Pleas Judge Alison McCarty's court Tuesday morning. Hose has been with the Fairlawn Fire Department for 30 years. "Copley Place is one of the best served areas you can have in Summit County," Hose said. "It's triangulated between three fire stations that have fire response vehicles and EMS vehicles." Copley Township, Jacob Pollock Attorneys Rest in Rothrock Road Trial

Tuesday was the ninth day of trial in the Copley v. Fairlawn Rothrock Road closure trial.

Plaintiff attorneys for Copley Township and Jacob Pollock officially rested their case Tuesday after hearing testimony from Dan Zarkovacki, part owner of the Fairway Park Apartments.  Summit County Common Pleas Judge Alison McCarty allowed Fairlawn to call witnesses before the plaintiffs rested because Pollock's attorney Jordan Berns couldn't schedule Zarkovacki to be in the courtroom any earlier.  Check out a play-by-play feed from Tuesday's court session here. Berns asked Zarkovacki several questions about the building of a proposed Walmart and Sam's Club complex on Rothrock Road and the filing of litigation challenging the zoning of the area.  Zarkovacki said the litigation was filed by Fairway Park Apartments against Copley Township. …
