Rothrock Road Closure Case Moved to June 1

Fairlawn and Copley officials were originally prepared to go to court on April 30.

It looks like at least until June.

On Thursday, Summit County Common Pleas Judge Alison McCarty moved the case of Copley Township v. Fairlawn from April 30 to June 1. Fairlawn City Council President Russ Sharnsky said he didn't know why the case was moved.

According to the court docket, depositions were finalized Thursday and Copley Township is ordered to submit responses to Fairlawn's motions by May 4.

Copley Township filed the lawsuit against Fairlawn on against traffic from a proposed Walmart Superstore and Sam's Club in Copley Township.

Fairlawn officials proposed installing a barricade that would open with a key card. Each resident would be given a key card to gain access.

Fairlawn's plan to issue the cards closes Rothrock Road west of Sawgrass Drive to commercial traffic: semis, buses, shoppers and delivery trucks headed to a proposed Walmart and Sam's club would lose a direct route to the proposed site.

The gates will open for emergency vehicles with a radio signal, and the design takes into account a traffic study of the area.

Mayor William Roth said the gates are within the jurisdiction of the city and he wants to put them up to protect 10 percent of the city's housing stock in that area.
